Article 2338 of the French Civil Code

The pledge is published by an entry in a special register, the terms of which are regulated by decree in the Conseil d’Etat.

Unless it is subject to article 2342, a pledge relating to a registered land motor vehicle or trailer is published by an entry in a register kept by the administrative authority under the conditions laid down by decree in the Conseil d’Etat. The registration of such a pledge prevents any new registration on the same vehicle.

Article 2338

Le gage est publié par une inscription sur un registre spécial dont les modalités sont réglées par décret en Conseil d’Etat.

Sauf s’il est soumis à l’article 2342, le gage portant sur un véhicule terrestre à moteur ou une remorque immatriculés est publié par une inscription sur un registre tenu par l’autorité administrative dans les conditions fixées par décret en Conseil d’Etat. L’inscription d’un tel gage fait obstacle à toute nouvelle inscription sur le même véhicule.
