Article 251 of the French Customs Code

1. Any voluntary operation that results in the loss of the francisation of a mortgaged vessel is prohibited, with the exception of the suspension of the francisation referred to in article L. 5112-1-7 of the French Transport Code.

2. If this operation is also committed with the intention of violating this prohibition, the perpetrator is liable to the penalties for breach of trust set out in articles 314-1 and 314-10 of the Criminal Code.

3. Mortgages granted by the purchaser prior to francization on a vessel purchased or built abroad are valid and effective provided they are published in France.

1. Toute opération volontaire qui entraîne la perte de la francisation d’un bâtiment grevé d’une hypothèque est interdite, à l’exception de la suspension de la francisation mentionnée à l’article L. 5112-1-7 du code des transports.

2. Si cette opération est en outre commise dans l’intention de violer cette interdiction, l’auteur est passible des peines de l’abus de confiance prévues par les articles 314-1 et 314-10 du code pénal.

3. Les hypothèques consenties par l’acheteur avant la francisation sur un bâtiment acheté ou construit à l’étranger sont valables et produisent effet à condition d’être publiées en France.
