Article 2528 of the French Civil Code

Rights subject to registration pursuant to article 2521 are, if they have not been registered, unenforceable against third parties who, on the same immovable, have acquired, from the same author, competing rights subject to registration.

These rights are also unenforceable, if they have been registered, when the rights invoked by these third parties, were previously registered.

Third parties who were themselves responsible for having the competing rights published, or their universal successors in title, may not, however, avail themselves of this provision.

Article 2528

Les droits soumis à inscription en application de l’article 2521 sont, s’ils n’ont pas été inscrits, inopposables aux tiers qui, sur le même immeuble, ont acquis, du même auteur, des droits concurrents soumis à inscription.

Ces droits sont également inopposables, s’ils ont été inscrits, lorsque les droits invoqués par ces tiers, ont été antérieurement inscrits.

Ne peuvent toutefois se prévaloir de cette disposition les tiers qui étaient eux-mêmes chargés de faire publier les droits concurrents, ou leurs ayants cause à titre universel.
