This Code shall apply in Mayotte under the conditions defined in this Book.
For the application of this code in Mayotte, the terms listed below are replaced as follows: 1° (Repealed); 2° “Court” or “court of appeal” by: “chambre d’appel de Mamoudzou”; 3° “Juge d’instance” by: “président du tribunal de première instance ou son délégué”; 4° “Département” or “arrondissement” by: “collectivité départementale”; 5° (Deleted); 6° “Décret du 4 janvier 1955” by: “provisions of Title IV of Book IV”; 7°”Service chargé de la publicité…
The articles 1 to 6 shall apply to Mayotte.
Book I is applicable to Mayotte subject to the following provisions.
For a child born in Mayotte, the first paragraph of article 21-7 and article 21-11 are applicable only if, at the date of birth, at least one of the child’s parents was residing in France legally, under cover of a residence permit, and uninterruptedly for more than three months.
Article 2493 is applicable under the conditions set out in Article 17-2. However, articles 21-7 and 21-11 are applicable to a child born in Mayotte to foreign parents before the entry into force of the loi n° 2018-778 du 10 septembre 2018 pour une immigration maîtrisée, un droit d’asile effectif et une intégration réussie, si l’un des parents justifie avoir résidé en France de manière régulière pendant la période de…
Articles 515-14 to 710, with the exception of articles 642 and 643, are applicable in Mayotte subject to the adaptations provided for in Articles 2501 et 2502. The provisions relating to buildings apply only subject to the provisions of Title IV of this Book.
For the application of article 524, are subject to the regime of immovables by destination, when they have been placed by the owner for the service and exploitation of the land, the fish of bodies of water having no communication with watercourses, canals and streams and the fish of fish farms and fish ponds. .
For the application of article 564, the words: “or body of water referred to in articles 432 and 433 du code rural” are replaced by the words: “pisciculture ou enclos piscicoles”.
