Article 2534 of the French Civil Code

For the purposes of their publication, distraint orders relating to lots depending on an immovable subject to the status of co-ownership are deemed not to relate to the share of the common parts included in these lots.

Nevertheless, distraining creditors exercise their right over the said share, taken in its consistency at the time of the transfer, the price of which forms the subject of the distribution.

Pour les besoins de leur publication, les ordonnances d’exécution forcée portant sur des lots dépendant d’un immeuble soumis au statut de la copropriété sont réputées ne pas porter sur la quote-part des parties communes comprises dans ces lots.

Néanmoins, les créanciers saisissants exercent leur droit sur ladite quote-part, prise dans sa consistance au moment de la mutation dont le prix forme l’objet de la distribution.
