Article 254 of the French Civil Code

The judge shall, at the outset of the proceedings, unless the parties or the sole constituted party waive this, hold a hearing at the end of which he shall take the necessary measures to ensure the existence of the spouses and children from the filing of the application for divorce to the date on which the judgment becomes res judicata, taking into consideration any agreements of the spouses.

Le juge tient, dès le début de la procédure, sauf si les parties ou la partie seule constituée y renoncent, une audience à l’issue de laquelle il prend les mesures nécessaires pour assurer l’existence des époux et des enfants de l’introduction de la demande en divorce à la date à laquelle le jugement passe en force de chose jugée, en considération des accords éventuels des époux.
