Article 276-4 of the French Civil Code

The debtor of a compensatory allowance in the form of an annuity may, at any time, apply to the judge for the substitution of a capital sum for all or part of the annuity. The substitution is made in accordance with procedures laid down by decree in the Conseil d’Etat.

The creditor of the compensatory allowance may make the same application if he establishes that a change in the debtor’s situation allows this substitution, in particular at the time of the liquidation of the matrimonial property regime.

The enforcement procedures provided for in articles 274, 275 and 275-1 are applicable. The judge’s refusal to substitute a capital sum for all or part of the annuity must be specially justified.

Article 276-4

Le débiteur d’une prestation compensatoire sous forme de rente peut, à tout moment, saisir le juge d’une demande de substitution d’un capital à tout ou partie de la rente. La substitution s’effectue selon des modalités fixées par décret en Conseil d’Etat.

Le créancier de la prestation compensatoire peut former la même demande s’il établit qu’une modification de la situation du débiteur permet cette substitution, notamment lors de la liquidation du régime matrimonial.

Les modalités d’exécution prévues aux articles 274, 275 et 275-1 sont applicables. Le refus du juge de substituer un capital à tout ou partie de la rente doit être spécialement motivé.
