Article 279 of the French Civil Code

The homologated agreement has the same enforceability as a court decision.

It can only be amended by a new agreement between spouses, also subject to homologation.

The spouses nevertheless have the option of stipulating in their agreement that each of them may, in the event of a significant change in the resources or needs of either of the parties, ask the judge to review the compensatory allowance. The provisions set out in the second and third paragraphs of article 275 as well as articles 276-3 and 276-4 are also applicable, depending on whether the compensatory allowance takes the form of a lump sum or a temporary or life annuity.

Unless the agreement provides otherwise, articles 280 to 280-2 apply.

The third and penultimate paragraphs of this article apply to the divorce agreement drawn up by private deed countersigned by lawyers, deposited in the minutes of a notary.

Article 279

La convention homologuée a la même force exécutoire qu’une décision de justice.

Elle ne peut être modifiée que par une nouvelle convention entre des époux, également soumise à homologation.

Les époux ont néanmoins la faculté de prévoir dans leur convention que chacun d’eux pourra, en cas de changement important dans les ressources ou les besoins de l’une ou l’autre des parties, demander au juge de réviser la prestation compensatoire. Les dispositions prévues aux deuxième et troisième alinéas de l’article 275 ainsi qu’aux articles 276-3 et 276-4 sont également applicables, selon que la prestation compensatoire prend la forme d’un capital ou d’une rente temporaire ou viagère.

Sauf disposition particulière de la convention, les articles 280 à 280-2 sont applicables.

Les troisième et avant-dernier alinéas du présent article s’appliquent à la convention de divorce établie par acte sous signature privée contresigné par avocats, déposé au rang des minutes d’un notaire.
