Article 296 of the French Code of Criminal Procedure

The trial jury is composed of six jurors when the court rules at first instance and nine jurors when it rules on appeal.

The court must, by judgment, order, before the list of jurors is drawn, that, independently of the trial jurors, one or more additional jurors be drawn by lot to attend the proceedings and to be present, without being able to express their opinion, during the deliberation.

In the event that one or more of the trial jurors is prevented from following the proceedings or taking part in the deliberations until the judgment of the Assize Court is delivered, they are replaced by the additional jurors.

The replacement is made in the order in which the additional jurors were called by lot.

Le jury de jugement est composé de six jurés lorsque la cour statue en premier ressort et de neuf jurés lorsqu’elle statue en appel.

La cour doit, par arrêt, ordonner, avant le tirage de la liste des jurés, qu’indépendamment des jurés de jugement, il soit tiré au sort un ou plusieurs jurés supplémentaires qui assistent aux débats et qui assistent, sans pouvoir manifester leur opinion, au délibéré.

Dans le cas où l’un ou plusieurs des jurés de jugement seraient empêchés de suivre les débats ou de prendre part à la délibération jusqu’au prononcé de l’arrêt de la cour d’assises, ils sont remplacés par les jurés supplémentaires.

Le remplacement se fait suivant l’ordre dans lequel les jurés supplémentaires ont été appelés par le sort.
