Article 304-1 of the French Code of Criminal Procedure

When the assize court ruling on appeal is to rule solely on the sentence, the speech to the jurors provided for in Article 304 is amended as follows:

1° The words: “the charges to be brought against X …” are replaced by the words: “the evidence against X which led to his conviction”;

2° The words: “to remind you that the accused is presumed innocent and that doubt must benefit him; to decide on the basis of the charges and the means of defence” are replaced by the words: “to decide on the sentence on the basis of the charges and the means of defence”.

Lorsque la cour d’assises statuant en appel doit se prononcer uniquement sur la peine, le discours aux jurés prévu à l’article 304 est ainsi modifié :


1° Les mots : “ les charges qui seront portées contre X … ” sont remplacés par les mots : “ les éléments de preuves retenus contre X, qui ont conduit à sa déclaration de culpabilité ” ;


2° Les mots : “ de vous rappeler que l’accusé est présumé innocent et que le doute doit lui profiter ; de vous décider d’après les charges et les moyens de défense ” sont remplacés par les mots : “ de vous prononcer sur la peine d’après les charges et les moyens de défense ”.
