The coefficients applicable to works belonging to the genre of audiovisual adaptation of live performances are determined as follows:
I.-The works are divided into two groups:
1° First group: works whose French hourly expenditure is equal to or greater than €400,000;
2° Second group: works whose French hourly expenditure is less than €400,000 and equal to or greater than €54,000.
II – The coefficients applied to the duration of the works are as follows:
1° First group: 3;
2° Second group: the coefficient varies between 3 and 0.54 in proportion to the amount of French hourly expenditure. This coefficient is rounded to four decimal places.
III-For audiovisual adaptations of live performances consisting of the recording in its entirety of a pre-existing live performance given on stage in the presence of the public but not giving rise to at least two recording sessions of this performance in its entirety by means of a multi-camera technical device, the coefficients provided for in II are reduced by 30%.
However, this reduction does not apply when the following three conditions are met:
-the number of working days recorded on the positions listed in the last paragraph of 3° of Article 311-59 is greater than 30;
-recording of the show and post-production work are carried out in 4K format;
-the exploitation rights for the audiovisual adaptation of the show are held by the line producer for at least three modes of exploitation, including video on demand by subscription, for all countries of the European Union and for a period of at least 20 years. In the case of an audiovisual adaptation of a contemporary music show, the aforementioned term is at least 10 years.
