Article 313 of the French Code of civil procedure

If the incident is raised before a court other than the court of first instance or the court of appeal, proceedings shall be stayed until a ruling has been given on the forgery, unless the disputed document is removed from the debate when a ruling can be given on the main issue without taking it into account.

The forgery shall be registered as provided for in articles 314 to 316. The document registering the forgery must be submitted to the registry of the judicial court within one month of the decision to stay the proceedings, failing which the incident is disregarded and the disputed document is deemed to have been recognised between the parties.

Article 313

Si l’incident est soulevé devant une juridiction autre que le tribunal judiciaire ou la cour d’appel, il est sursis à statuer jusqu’au jugement sur le faux à moins que la pièce litigieuse ne soit écartée du débat lorsqu’il peut être statué au principal sans en tenir compte.

Il est procédé à l’inscription de faux comme il est dit aux articles 314 à 316. L’acte d’inscription de faux doit être remis au greffe du tribunal judiciaire dans le mois de la décision de sursis à statuer, faute de quoi il est passé outre à l’incident et l’acte litigieux est réputé reconnu entre les parties.
