If the request for recusal is accepted, the judge shall be replaced.
If the request for referral on grounds of legitimate suspicion is granted, the case shall be referred to another formation of the court initially seised or to another court of the same nature. This decision is binding on the parties and on the referring court. In the event of referral to another court, the procedure shall be as set out in Article 82.
The procedural acts carried out by the judge or court before the decision granting the application for recusal or referral on grounds of legitimate suspicion was brought to its attention may not be called into question. However, a decision rendered by the court or tribunal which disposes of all or part of the main issue or which, without disposing of the main issue, is provisionally enforceable, irrespective of its date, is null and void.
