Article 380-6 of the French Code of Criminal Procedure

The assize court ruling on appeal on the civil action may not, on the sole appeal of the accused, the civilly liable person or the civil party, aggravate the fate of the appellant.

The civil party may not, on appeal, make any new claim; however, it may request an increase in damages for loss suffered since the first decision. Even where no appeal has been lodged against the decision on the civil action, the victim who was constituted as a civil party in the first instance may exercise before the Assize Court ruling on the appeal the rights granted to the civil party until the close of the proceedings; he or she may also request the application of the provisions of this paragraph, as well as that of article 375.

La cour d’assises statuant en appel sur l’action civile ne peut, sur le seul appel de l’accusé, du civilement responsable ou de la partie civile, aggraver le sort de l’appelant.

La partie civile ne peut, en cause d’appel, former aucune demande nouvelle ; toutefois, elle peut demander une augmentation des dommages et intérêts pour le préjudice souffert depuis la première décision. Même lorsqu’il n’a pas été fait appel de la décision sur l’action civile, la victime constituée partie civile en premier ressort peut exercer devant la cour d’assises statuant en appel les droits reconnus à la partie civile jusqu’à la clôture des débats ; elle peut également demander l’application des dispositions du présent alinéa, ainsi que de celle de l’article 375.
