Article 385 of the French Code of civil procedure

Principally, the proceedings are extinguished by the effect of the lapse of time, the discontinuance of the proceedings or the lapse of the summons.

In these cases, the finding that the proceedings are extinguished and that the court is no longer seised of the case does not preclude the institution of new proceedings, if the action is not otherwise extinguished.

L’instance s’éteint à titre principal par l’effet de la péremption, du désistement d’instance ou de la caducité de la citation.

Dans ces cas, la constatation de l’extinction de l’instance et du dessaisissement de la juridiction ne met pas obstacle à l’introduction d’une nouvelle instance, si l’action n’est pas éteinte par ailleurs.
