1. When the offences referred to in articles 412, 1° to 5°, 414, 414-2 and 459 have been duly recorded by an official authorised for this purpose, the president of the judicial court may order, at the request of the customs administration, in urgent cases, in view of the size of the sums to be secured, and in order to guarantee the payment of duties and taxes, fines and confiscations, all appropriate precautionary measures, at the advanced expense of the Treasury and in accordance with the procedures set out in the Code of Civil Procedure, against the assets of the person responsible for the offence.
2. The order of the President of the Judicial Court is enforceable notwithstanding any opposition or appeal.
However, the precautionary measures may be lifted if the party concerned provides security deemed sufficient.
3. Applications for the validity or release of precautionary measures shall fall within the jurisdiction of the President of the Tribunal judiciaire.
Sentencing or acceptance of a settlement by the interested party shall constitute validation of the protective measures and definitive registration of the securities.
If the case is dismissed, acquitted or acquittal is granted, the measures ordered are automatically released at the expense of the Treasury. The same applies if the prosecution is terminated.
