Article 39 of the French Code of civil procedure

Subject to the provisions of Article 35, the judgment shall not be subject to appeal where none of the incidental claims exceeds the rate of last resort.

If any of them exceeds that rate, the judge shall rule at first instance on all the claims. However, he shall rule at last instance if the only claim that exceeds the rate of last resort is a counterclaim for damages based exclusively on the original claim.

Sous réserve des dispositions de l’article 35, le jugement n’est pas susceptible d’appel lorsque aucune des demandes incidentes n’est supérieure au taux du dernier ressort.

Si l’une d’elles est supérieure à ce taux, le juge statue en premier ressort sur toutes les demandes. Il se prononce toutefois en dernier ressort si la seule demande qui excède le taux du dernier ressort est une demande reconventionnelle en dommages-intérêts fondée exclusivement sur la demande initiale.
