Article 392 of the French Code of civil procedure

Interruption of the proceedings entails interruption of the time limit.

This time limit continues to run in the event of suspension of the proceedings unless the proceedings are suspended only for a time or until the occurrence of a specified event; in the latter cases, a new time limit runs from the expiry of that time or the occurrence of that event.

A new time limit shall run from the expiry of the participatory procedure agreement for the purposes of readiness for hearing.

Where the proceedings have been interrupted by the decision to summon the parties to an amicable settlement hearing, a new time limit shall run from the first hearing subsequently set before the judge hearing the case.

L’interruption de l’instance emporte celle du délai de péremption.

Ce délai continue à courir en cas de suspension de l’instance sauf si celle-ci n’a lieu que pour un temps ou jusqu’à la survenance d’un événement déterminé ; dans ces derniers cas, un nouveau délai court à compter de l’expiration de ce temps ou de la survenance de cet événement.

Un nouveau délai court à compter de l’extinction de la convention de procédure participative aux fins de mise en état.

Lorsque l’instance a été interrompue par la décision de convocation des parties à une audience de règlement amiable, un nouveau délai court à compter de la première audience fixée postérieurement devant le juge saisi de l’affaire.
