Article 421 of the French Customs Code

Animals in the category of those prohibited from entry are deemed to have been imported fraudulently and animals in the category of those whose seizure is prohibited or subject to duties are deemed to be the subject of an attempt to export them as contraband in all the cases of infringement listed below:

1° When they are found in the zone defined in article 208-1 in violation of the provisions of articles 208 and 210 above and the decrees, orders and regulations issued for their application;

2° In the event of a shortfall noted during the censuses and checks provided for in article 211 above;

3° In the event of deception or misrepresentation with a view to improperly obtaining the issue of movement permits, the registration of animals in an open account or their cancellation, or the cancellation of commitments appearing on the acquits-à-caution.

Article 421

Les animaux de la catégorie de ceux qui sont prohibés à l’entrée sont réputés avoir été importés en fraude et les animaux de la catégorie de ceux dont la saisie est prohibée ou assujettie à des droits sont réputés faire l’objet d’une tentative d’exportation en contrebande dans tous les cas d’infraction ci-après indiqués :

1° Lorsqu’ils sont trouvés dans la zone définie à l’article 208-1 en violation des dispositions des articles 208 et 210 ci-dessus et des décrets, arrêtés et règlements pris pour leur application ;

2° En cas de déficit constaté lors des recensements et contrôles prévus par l’article 211 ci-dessus ;

3° En cas de manoeuvre ou fausse déclaration tendant à obtenir indûment la délivrance de titres de circulation, l’inscription d’animaux à un compte ouvert ou leur radiation, ou l’annulation des engagements figurant sur les acquits-à-caution.
