Article 43-1 of the French Code of Criminal Procedure

Where the public prosecutor’s office at the judicial court has, pursuant to this code, specialised and concurrent jurisdiction that extends to the jurisdictions of other judicial courts, whether specialised or not, this jurisdiction is exercised with priority over that of the public prosecutor’s offices at these courts as long as the public prosecution has not been initiated. When it decides to exercise its jurisdiction, the public prosecutors’ offices of these courts immediately relinquish jurisdiction in its favour.

Article 43-1

Lorsque le ministère public près le tribunal judiciaire dispose, en application du présent code, d’une compétence spécialisée et concurrente qui s’étend aux ressorts d’autres tribunaux judiciaires, spécialisés ou non, cette compétence s’exerce de façon prioritaire sur celle des parquets près ces tribunaux tant que l’action publique n’a pas été mise en mouvement. Lorsqu’il décide d’exercer sa compétence, les parquets près ces tribunaux se dessaisissent sans délai à son profit.
