Article 45 of the French Code of Criminal Procedure

The Public Prosecutor at the Judicial Court acts as Public Prosecutor before the Police Court for 5th class offences not covered by the fixed fine procedure. He may also occupy it in any matter before the police court, if he deems it appropriate, instead of the police commissioner who usually performs these functions under the supervision of the public prosecutor.

However, where forestry offences are referred to the police courts, the functions of the public prosecutor are performed by the regional director of the administration in charge of forests or by the official he designates, unless the public prosecutor deems it appropriate to perform these functions.

Le procureur de la République près le tribunal judiciaire occupe le siège du ministère public devant le tribunal de police pour les contraventions de la 5e classe ne relevant pas de la procédure de l’amende forfaitaire. Il peut l’occuper également en toute matière devant le tribunal de police, s’il le juge à propos, au lieu et place du commissaire de police qui exerce habituellement ces fonctions sous le contrôle du procureur de la République.

Toutefois, dans le cas où les infractions forestières sont soumises aux tribunaux de police, les fonctions du ministère public sont remplies par le directeur régional de l’administration chargée des forêts ou par le fonctionnaire qu’il désigne, sauf si le procureur de la République estime opportun d’occuper ces fonctions.
