Article 456 of the French Customs Code

All persons called upon in the course of their duties or responsibilities to intervene in the application of the laws and regulations governing financial relations with foreign countries are bound by professional secrecy and liable to the penalties provided for in Articles 226-13 and 226-14 of the French Criminal Code.

However, when legal proceedings have been initiated on the basis of a complaint by the Minister for the Economy and Finance, these same persons may not invoke professional secrecy against an investigating judge or court that questions them about the facts that are the subject of the complaint or related facts.

Sont tenues au secret professionnel et passibles des peines prévues par les articles 226-13 et 226-14 du code pénal, toutes personnes appelées à l’occasion de leurs fonctions ou de leurs attributions à intervenir dans l’application de la législation et de la réglementation des relations financières avec l’étranger.

Toutefois, lorsqu’une poursuite régulière a été engagée sur la plainte du ministre de l’économie et des finances, ces mêmes personnes ne peuvent opposer le secret professionnel au juge d’instruction ou au tribunal qui les interroge sur les faits faisant l’objet de la plainte ou sur des faits connexes.
