Article 465 of the French Customs Code

I.-Failure to comply with the reporting obligations set out in Articles L. 152-1 to L. 152-1-2 and in Regulation (EU) No 2018/1672 of the European Parliament and of the Council of 23 October 2018 on controls of cash entering or leaving the EU and repealing Regulation (EC) No 1889/2005 is investigated, recorded and punished under the conditions set out in Article L. 152-4 of the Monetary and Financial Code.

II – Customs officers may temporarily detain cash transported by bearer or sent without the intervention of a bearer, to or from abroad, under the conditions set out in II of Article L. 152-4 of the Monetary and Financial Code.

The temporary withholding decision may be appealed under the conditions set out inarticle L. 152-5 of the Monetary and Financial Code.

Article 465

I.-La méconnaissance des obligations déclaratives énoncées aux articles L. 152-1 à L. 152-1-2 et dans le règlement (UE) n° 2018/1672 du Parlement européen et du Conseil du 23 octobre 2018 relatif aux contrôles de l’argent liquide entrant dans l’Union ou sortant de l’Union et abrogeant le règlement (CE) n° 1889/2005, est recherchée, constatée et réprimée dans les conditions prévues à l’article L. 152-4 du code monétaire et financier.

II.-Les agents des douanes peuvent retenir temporairement l’argent liquide transporté par porteur ou faisant l’objet d’un envoi sans l’intervention d’un porteur, à destination ou en provenance de l’étranger, dans les conditions prévues au II de l’article L. 152-4 du code monétaire et financier.

La décision de retenue temporaire peut faire l’objet d’un recours dans les conditions prévues à l’article L. 152-5 du code monétaire et financier.
