Article 495-5 of the French Code of Criminal Procedure

The criminal order, to which no opposition has been lodged or which has not been brought by the public prosecutor to the hearing of the criminal court, has the effects of a judgment that has the force of res judicata.

However, the criminal order ruling solely on the public prosecution does not have the authority of res judicata with regard to the civil action for compensation for damages caused by the offence.

L’ordonnance pénale, à laquelle il n’a pas été formé opposition ou qui n’a pas été portée par le ministère public à l’audience du tribunal correctionnel, a les effets d’un jugement passé en force de chose jugée.

Cependant, l’ordonnance pénale statuant uniquement sur l’action publique n’a pas l’autorité de la chose jugée à l’égard de l’action civile en réparation des dommages causés par l’infraction.
