Article 495-7 of the French Civil Code

The judicial representative for the protection of adults receives the benefits included in the judicial support measure from an account opened in the person’s name with an establishment authorised to receive funds from the public, under the conditions set out in the first paragraph of article 472, subject to the provisions applicable to protective measures entrusted to persons or services acting on behalf of health establishments and social or medico-social establishments subject to public accounting rules.

He manages these services in the interests of the person, taking into account their opinion and family situation.

He takes educational action with the person concerned with a view to re-establishing the conditions for autonomous management of social benefits.

Article 495-7

Le mandataire judiciaire à la protection des majeurs perçoit les prestations incluses dans la mesure d’accompagnement judiciaire sur un compte ouvert au nom de la personne auprès d’un établissement habilité à recevoir des fonds du public, dans les conditions prévues au premier alinéa de l’article 472, sous réserve des dispositions applicables aux mesures de protection confiées aux personnes ou services préposés des établissements de santé et des établissements sociaux ou médico-sociaux soumis aux règles de la comptabilité publique.

Il gère ces prestations dans l’intérêt de la personne en tenant compte de son avis et de sa situation familiale.

Il exerce auprès de celle-ci une action éducative tendant à rétablir les conditions d’une gestion autonome des prestations sociales.
