Article 50 of the French Code of Criminal Procedure

The investigating judge, chosen from among the judges of the court, is appointed in the forms provided for the appointment of judges.

If necessary, another judge may be temporarily entrusted, in the same forms, with the duties of investigating judge concurrently with the magistrate appointed as stated in the first paragraph.

If the First President delegates a judge to the court, he may also, under the same conditions, temporarily entrust the latter with the investigation by means of an order.

If the investigating judge is absent, ill or otherwise prevented from attending, the judicial court shall designate one of the judges of that court to replace him.

Article 50

Le juge d’instruction, choisi parmi les juges du tribunal, est nommé dans les formes prévues pour la nomination des magistrats du siège.

En cas de nécessité, un autre juge peut être temporairement chargé, dans les mêmes formes, des fonctions de juge d’instruction concurremment avec le magistrat désigné ainsi qu’il est dit au premier alinéa.

Si le premier président délègue un juge au tribunal, il peut aussi, dans les mêmes conditions, charger temporairement celui-ci de l’instruction par voie d’ordonnance.

Si le juge d’instruction est absent, malade ou autrement empêché, le tribunal judiciaire désigne l’un des juges de ce tribunal pour le remplacer.
