Article 509-11 of the French Code of civil procedure

Applications for a declaration that there are no grounds for refusing recognition and for refusal of recognition respectively made pursuant to Articles 30 and 40 of Council Regulation (EU) 2019/1111 of 25 June 2019 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, and international child abduction (recast) shall be brought before the president, or his delegate, of the judicial court within whose jurisdiction the domicile of the plaintiff or defendant is situated, in compliance with Article L. 211-12 of the Code of Judicial Organisation when the decision was given in relation to the international wrongful removal of children.

Where none of the domiciles mentioned in the first paragraph are in France, these applications are brought before the President of the Paris Judicial Court or his delegate.

Les demandes aux fins de constat de l’absence de motifs de refus de reconnaissance et aux fins de refus de reconnaissance respectivement formées en application des articles 30 et 40 du règlement (UE) 2019/1111 du conseil du 25 juin 2019 relatif à la compétence, la reconnaissance et l’exécution des décisions en matière matrimoniale et en matière de responsabilité parentale, ainsi qu’à l’enlèvement international d’enfants (refonte) sont portées devant le président, ou son délégué, du tribunal judiciaire dans le ressort duquel se trouve le domicile du demandeur ou du défendeur, dans le respect de l’article L. 211-12 du code de l’organisation judiciaire lorsque la décision a été rendue en matière de déplacement illicite international d’enfants.

Lorsqu’aucun des domiciles mentionnés au premier alinéa ne se trouve en France, ces demandes sont portées devant le président du tribunal judiciaire de Paris ou son délégué.
