An application by a party who appeared at first instance without commenting on provisional enforcement is admissible only if, in addition to the existence of a serious ground for annulment or reversal, provisional enforcement is likely to entail manifestly excessive consequences which became apparent after the decision at first instance.
In the event of an objection, the court may order the provisional enforcement of the judgment.
In the event of opposition, the judge who handed down the decision may, of his own motion or at the request of a party, halt provisional enforcement as of right where it is likely to entail manifestly excessive consequences.
