A criminal order that has not been opposed has the effects of a judgment that has become res judicata.

However, it does not have the authority of res judicata with regard to the civil action for damages caused by the offence.

L’ordonnance pénale à laquelle il n’a pas été formé opposition a les effets d’un jugement passé en force de chose jugée.

Cependant, elle n’a pas l’autorité de la chose jugée à l’égard de l’action civile en réparation des dommages causés par l’infraction.
