The summons is issued at the request of the public prosecutor, the civil party, and any administration that is legally empowered to do so. The bailiff must comply with their request without delay.
The summons states the act being prosecuted and refers to the text of the law that punishes it.
It indicates the court seised, the place, time and date of the hearing, and specifies the status of the person summoned as an accused person, as a civilly liable person, or as a witness.
If it is issued at the request of the civil party, it mentions, in the case of a natural person, his surname, forenames, profession and real or elected domicile and, in the case of a legal person, its form, name, registered office and the body that legally represents it.
The summons issued to a witness must also mention that failure to appear, refusal to testify and perjury are punishable by law.
