1. Manufactured tobacco may be imported, introduced and wholesaled in mainland France by any natural or legal person who establishes itself as a supplier with a view to carrying on this activity under the conditions laid down by decree of the Conseil d’Etat.
2. In the same territory, the manufacture of manufactured tobacco may be carried out by any natural or legal person who establishes itself as a manufacturer with a view to carrying out this activity under the conditions laid down by decree in the Conseil d’Etat. The provisions of articles 570 and 571 apply to such a person as a supplier. Retail sales of manufactured tobacco are reserved for the State.
3. Natural or legal persons who supply holders of the purchaser-reseller status provided for in the twelfth paragraph of article 568 are not required to establish themselves as suppliers in order to introduce, wholesale and, where applicable, import manufactured tobacco. These persons are subject to the product monitoring and management rules mentioned in 2°, 6° and 7° of article L. 311-39 of the code of taxes on goods and services.
