Article 59 of the French Civil Code

In the event of a birth during a sea voyage, a record will be drawn up within three days of the birth on the declaration of the father, if he is on board.

If the birth takes place during a stopover in a port, the record will be drawn up under the same conditions, when it is impossible to communicate with the land, or when there is no French diplomatic or consular agent in the port, if abroad, invested with the functions of a civil registrar.

This act will be drawn up, namely: on State vessels, by the ship’s commissioner or, in his absence, by the commanding officer or whoever performs the duties; and on other vessels, by the captain, master or skipper, or by whoever performs the duties.

A mention will be made of which of the above circumstances the deed was drawn up in. The act will be entered at the end of the logbook.

Article 59

En cas de naissance pendant un voyage maritime, il en sera dressé acte dans les trois jours de l’accouchement sur la déclaration du père, s’il est à bord.

Si la naissance a lieu pendant un arrêt dans un port, l’acte sera dressé dans les mêmes conditions, lorsqu’il y aura impossibilité de communiquer avec la terre, ou lorsqu’il n’existera pas dans le port, si l’on est à l’étranger, d’agent diplomatique ou consulaire français investi des fonctions d’officier de l’état civil.

Cet acte sera rédigé, savoir : sur les bâtiments de l’Etat, par le commissaire des armées du bâtiment ou, à son défaut, par le commandant ou celui qui en remplit les fonctions ; et sur les autres bâtiments, par le capitaine, maître ou patron, ou par celui qui en remplit les fonctions.

Il y sera fait mention de celle des circonstances ci-dessus prévues, dans laquelle l’acte a été dressé. L’acte sera inscrit à la suite du livre de bord.
