Article 6-1 of the French Code of Criminal Procedure

Where a felony or misdemeanour allegedly committed in the course of criminal proceedings or proceedings before a court involves the violation of a rule of procedure, public action may only be brought if the unlawful nature of the proceedings, the decision taken or the act performed on that occasion has been established by a decision that has become final of the criminal court seised or in application of the remedies provided by law or regulation. The limitation period for public prosecution runs from the date of this decision.

This article applies in particular in the event of prosecution on the basis of the Article 432-12-1 of the Penal Code.

Article 6-1

Lorsqu’un crime ou un délit prétendument commis à l’occasion d’une poursuite pénale ou d’une instance devant une juridiction impliquerait la violation d’une règle de procédure, l’action publique ne peut être exercée que si le caractère illégal de la poursuite, de la décision intervenue ou de l’acte accompli à cette occasion a été constaté par une décision devenue définitive de la juridiction répressive saisie ou en application des voies de recours prévues par la loi ou le règlement. Le délai de prescription de l’action publique court à compter de cette décision.

Le présent article est notamment applicable en cas de poursuites sur le fondement de l’article 432-12-1 du code pénal.
