Customs officers may only immobilise means of transport and goods or keep persons at their disposal for the time strictly necessary to carry out the physical inspection operations, which include checking the goods, means of transport or person and, where applicable, seizures.
After four hours from the start of the inspection operations, the public prosecutor is informed of these operations by any means.
This obligation to inform does not apply in the following cases:
1° When the inspections are carried out pursuant to article 60-8 only in the presence of a representative or a person requested for this purpose by the customs officers in the places mentioned in 3° of article 60-1, excluding inspections taking place in the vicinity of these places;
2° When inspections of goods and means of transport, including in the presence of a person, are carried out in the places mentioned in 2° of the same article 60-1 ;
3° When the inspections are carried out in the places mentioned in article 60-4.
Customs officers may take the necessary and appropriate measures to ensure the preservation of goods and means of transport and the safety of persons.
When the visit is materially impossible or when in-depth investigations that cannot be carried out on site must be carried out, customs officers may order the transfer of goods, means of transport and persons to an appropriate location.
