Article 612-1 of the French Code of Criminal Procedure

In all matters, where the interests of public policy or the proper administration of justice so require, the Cour de cassation may order that the annulment it pronounces shall have effect in respect of parties to the proceedings who have not lodged an appeal.

A convicted person who has not lodged an appeal and in whose favour the annulment of the conviction has been extended pursuant to the provisions of the first paragraph may not be sentenced to a penalty greater than that imposed by the court whose decision has been annulled.

Article 612-1

En toute matière, lorsque l’intérêt de l’ordre public ou d’une bonne administration de la justice le commande, la Cour de cassation peut ordonner que l’annulation qu’elle prononce aura effet à l’égard des parties à la procédure qui ne se sont pas pourvues.

Le condamné qui ne s’est pas pourvu et au profit duquel l’annulation de la condamnation a été étendue en application des dispositions du premier alinéa ne peut être condamné à une peine supérieure à celle prononcée par la juridiction dont la décision a été annulée.
