Article 612 of the French Code of Criminal Procedure

In criminal or police matters, if the judgment and proceedings are set aside for lack of jurisdiction, the Cour de cassation refers the case back to the judges who must hear it and designates them.

The Cour de cassation may annul only part of the decision where the nullity vitiates only one or some of these provisions.

En matière correctionnelle ou de police, si l’arrêt et la procédure sont annulés pour cause d’incompétence, la Cour de cassation renvoie le procès devant les juges qui doivent en connaître et les désigne.

La Cour de cassation peut n’annuler qu’une partie de la décision lorsque la nullité ne vicie qu’une ou quelques-unes de ces dispositions.
