1° Under the derogating provisions of Article 2a, the customs administration is authorised to check the quantity, quality, markings, packaging, destination or use of goods with national or Community status, for which any benefit allocated by the European Agricultural Guidance and Guarantee Fund, Guarantee Section, or by the European Agricultural Guarantee Fund, is requested.
In addition, it is authorised to issue approvals in accordance with current Community regulations, where these are necessary for the granting of benefits of any kind applied for from the European Agricultural Guidance and Guarantee Fund, Guarantee Section, or the European Agricultural Guarantee Fund.
2° Goods with national or Community status, exported to another Member State of the European Community, imported from another Member State of the European Community or subject to an operation on customs territory and for which the use or destination is controlled in accordance with Community regulations, are presented to the customs service. Customs officers are responsible for endorsing the control documents relating to these goods.
The categories of goods referred to in the previous paragraph and the procedures for presentation to customs are laid down by an order of the Minister responsible for customs.
3° The controls referred to in 1, when they concern goods subject to operations within the customs territory of the European Community, and the controls referred to in 2 are carried out in accordance with the provisions of Articles 1, 2, 3, 322a, 468 and 469 as well as this Title.
4° In all cases, customs officers have access to premises and land used for business purposes, excluding homes or the part of the premises used as a home, between 8 a.m. and 8 p.m. or, outside these hours, when an activity is in progress.

6° The provisions of Title XII, with the exception of articles 410 to 412, 414 to 430, and Title XV are applicable when customs officers are unable to carry out the controls provided for in 3 and 4 above.
7° The penalties provided for in Article 414-2 are applicable in the event of a fraudulent act the purpose or effect of which is to obtain, in whole or in part, any advantage granted by the European Agricultural Guidance and Guarantee Fund, Guarantee Section, or by the European Agricultural Guarantee Fund, when the goods in question are the subject of operations within the customs territory of the European Community. In the event of an unintentional irregularity, Article 410 shall apply.
