Article 662-1 of the French Code of civil procedure

Service by electronic means is effected by the transmission of the document to its addressee under the conditions laid down in Title XXI of this Book. The articles 654 to 662 do not apply.

The document of service shall mention the addressee’s consent to this method of service.

Service by electronic means is personal service if the addressee of the document became aware of it on the day of transmission of the document. In other cases, service is home service and the bailiff must notify the interested party of the service, on the first working day, by simple letter mentioning the delivery of service by electronic means as well as the nature of the document and the name of the applicant.

La signification par voie électronique est faite par la transmission de l’acte à son destinataire dans les conditions prévues par le titre XXI du présent livre. Les articles 654 à 662 ne sont pas applicables.

L’acte de signification porte mention du consentement du destinataire à ce mode de signification.

La signification par voie électronique est une signification faite à personne si le destinataire de l’acte en a pris connaissance le jour de la transmission de l’acte. Dans les autres cas, la signification est une signification faite à domicile et l’huissier de justice doit aviser l’intéressé de la signification, le premier jour ouvrable, par lettre simple mentionnant la délivrance de la signification par voie électronique ainsi que la nature de l’acte et le nom du requérant.
