If the court normally having jurisdiction cannot be composed because of the existence of the incompatibilities provided for by law, the first president of the court of appeal may order the transfer to the adjoining court situated within the jurisdiction of that court and designated by the order provided for in the last paragraph of this article.
The application for transfer shall be made by the public prosecutor of the court seised.
It shall be served on all interested parties, who shall have a period of ten days to submit their observations to the first president.
The latter rules within fifteen days of the application. His decision constitutes a measure of judicial administration that is not subject to appeal.
After consulting the presidents of the judicial courts concerned and the public prosecutor, the first president shall each year issue an order indicating, for each of the courts within his jurisdiction, the court to which proceedings are likely to be transferred pursuant to the provisions of this article. This order may not be amended during the course of the year.
