Customs officers are authorised to record the identity of persons in order to draw up the reports provided for in this code.
If the person refuses or is unable to prove his identity, the customs officers appointed as station managers or the officials designated by them holding the rank of controller or higher may report the matter to any judicial police officer from the national police force or the national gendarmerie with territorial jurisdiction, who may then immediately order them to present the offender for identity checks under the conditions set out inarticle 78-3 of the code of criminal procedure. The period provided for in the third paragraph of this article runs from the date of the identity record referred to in the first paragraph of this article.
The results of this identity check are communicated without delay to the customs officers.
