Article 67 D-9 of the French Customs Code

Customs officers authorised under the conditions provided for in the first paragraph ofArticle 67 D-6 who observe non-compliance with the measures ordered pursuant to the first paragraph ofArticle 67 D-7, when they concern a person providing an intermediary service, within the meaning of Article 3(g) of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 referred to above, may ask the court seised pursuant to the second paragraph of Article 67 D-7 of this Code to impose a periodic penalty payment in order to ensure that the decision is enforced. The amount and duration of the periodic penalty payment are set in the light of the seriousness of the breach and the ability of the intermediary in question to pay, up to a maximum of 250,000 euros. The court that has imposed the periodic penalty payment has the power to liquidate it. It may order the publication, dissemination or posting of its decision or an extract therefrom, in accordance with the terms and conditions it specifies.

Les agents des douanes habilités dans les conditions prévues au premier alinéa de l’article 67 D-6 qui constatent le non-respect des mesures ordonnées en application du premier alinéa de l’article 67 D-7, lorsqu’elles visent une personne fournissant un service intermédiaire, au sens du g de l’article 3 du règlement (UE) 2022/2065 du Parlement européen et du Conseil du 19 octobre 2022 précité, peuvent demander à la juridiction saisie en application du deuxième alinéa de l’article 67 D-7 du présent code de prononcer une astreinte afin de garantir l’exécution de la décision. Le montant et la durée de l’astreinte sont fixés en considération de la gravité du manquement et des facultés contributives de l’intermédiaire mis en cause, pour un montant maximal de 250 000 euros. La juridiction qui a prononcé l’astreinte est compétente pour la liquider. Elle peut ordonner la publication, la diffusion ou l’affichage de sa décision ou d’un extrait de celle-ci, selon les modalités qu’elle précise.
