Article 687-2 of the French Code of civil procedure

The date of service of a judicial or extrajudicial document abroad is, without prejudice to the provisions of Article 687-1, with regard to the person to whom it is made, the date on which the document is delivered or validly served to him.

Where it has not been possible to deliver or serve the document to the addressee, service is deemed to have been effected on the date on which the competent foreign authority or the French consular or diplomatic representative attempted to deliver or serve the document, or where this date is unknown, the date on which one of these authorities informed the requesting French authority that it was impossible to serve the document.

Where no certificate describing the execution of the request could be obtained from the competent foreign authorities, notwithstanding the approaches made to them, service is deemed to have been effected on the date the document was sent to them.

Article 687-2

La date de notification d’un acte judiciaire ou extrajudiciaire à l’étranger est, sans préjudice des dispositions de l’article 687-1, à l’égard de celui à qui elle est faite, la date à laquelle l’acte lui est remis ou valablement notifié.

Lorsque l’acte n’a pu être remis ou notifié à son destinataire, la notification est réputée avoir été effectuée à la date à laquelle l’autorité étrangère compétente ou le représentant consulaire ou diplomatique français a tenté de remettre ou notifier l’acte, ou lorsque cette date n’est pas connue, celle à laquelle l’une de ces autorités a avisé l’autorité française requérante de l’impossibilité de notifier l’acte.

Lorsqu’aucune attestation décrivant l’exécution de la demande n’a pu être obtenue des autorités étrangères compétentes, nonobstant les démarches effectuées auprès de celles-ci, la notification est réputée avoir été effectuée à la date à laquelle l’acte leur a été envoyé.
