Article 694-2 of the French Code of Criminal Procedure

Requests for mutual assistance from foreign judicial authorities shall be executed by the public prosecutor or by officers or agents of the judicial police requested for this purpose by that magistrate.

They shall be executed by the investigating judge or by officers of the judicial police acting on a rogatory commission from that magistrate when they require certain procedural acts that can only be ordered or executed during a preparatory investigation.

Article 694-2

Les demandes d’entraide émanant des autorités judiciaires étrangères sont exécutées par le procureur de la République ou par les officiers ou agents de police judiciaire requis à cette fin par ce magistrat.

Elles sont exécutées par le juge d’instruction ou par des officiers de police judiciaire agissant sur commission rogatoire de ce magistrat lorsqu’elles nécessitent certains actes de procédure qui ne peuvent être ordonnés ou exécutés qu’au cours d’une instruction préparatoire.
