Article 695-16 of the French Code of Criminal Procedure

The Public Prosecutor’s Office at the investigating, trial or enforcement court that has issued an arrest warrant shall execute it in the form of a European arrest warrant either at the request of the court or of its own motion, in accordance with the rules and under the conditions determined by the articles 695-12 to 695-15.

In the absence of a waiver of the benefit of the principle of speciality, where the person sought has already been surrendered to France for any act other than that for which he or she is again sought, the Public Prosecutor’s Office at the trial, investigating or enforcement court that issued a bring warrant shall execute it in the form of a European arrest warrant.

The Public Prosecutor’s Office shall also be competent, if it considers it necessary, to ensure, in the form of a European arrest warrant, the execution of custodial sentences of four months or more handed down by the trial courts, in accordance with the rules and under the conditions determined by Articles 695-12 to 695-15.

Article 695-16

Le ministère public près la juridiction d’instruction, de jugement ou d’application des peines ayant décerné un mandat d’arrêt met celui-ci à exécution sous la forme d’un mandat d’arrêt européen soit à la demande de la juridiction, soit d’office, selon les règles et sous les conditions déterminées par les articles 695-12 à 695-15.

En l’absence de renonciation au bénéfice du principe de spécialité, lorsque la personne recherchée a déjà été remise à la France pour un fait quelconque autre que celui pour lequel elle est de nouveau recherchée, le ministère public près la juridiction de jugement, d’instruction ou d’application des peines ayant décerné un mandat d’amener met celui-ci à exécution sous la forme d’un mandat d’arrêt européen.

Le ministère public est également compétent, s’il l’estime nécessaire, pour assurer, sous la forme d’un mandat d’arrêt européen, l’exécution des peines privatives de liberté d’une durée supérieure ou égale à quatre mois prononcées par les juridictions de jugement, selon les règles et sous les conditions déterminées par les articles 695-12 à 695-15.
