Article 695-39 of the French Code of Criminal Procedure

Where the requested person is being prosecuted in France or has already been sentenced there and must serve a sentence there for an act other than that covered by the European arrest warrant, the Investigating Chamber may, after ruling on the execution of the arrest warrant, defer the surrender of the person concerned. The Public Prosecutor will then immediately notify the issuing judicial authority.

The Investigating Chamber may also decide on the temporary surrender of the wanted person. The Public Prosecutor shall immediately inform the issuing judicial authority and agree with it, in writing, the conditions and time limits for the surrender.

Lorsque la personne recherchée est poursuivie en France ou y a déjà été condamnée et doit y purger une peine en raison d’un fait autre que celui visé par le mandat d’arrêt européen, la chambre de l’instruction peut, après avoir statué sur l’exécution du mandat d’arrêt, différer la remise de l’intéressé. Le procureur général en avise alors immédiatement l’autorité judiciaire d’émission.

La chambre de l’instruction peut également décider la remise temporaire de la personne recherchée. Le procureur général en informe immédiatement l’autorité judiciaire d’émission et convient avec elle, par écrit, des conditions et des délais de la remise.
