Article 695-38 of the French Code of Criminal Procedure

The provisions of Article 695-37 do not preclude the Investigating Chamber, after ruling on the execution of the European arrest warrant, from temporarily postponing the surrender for serious humanitarian reasons, in particular if the surrender of the wanted person is likely to have serious consequences for him or her due in particular to his or her age or state of health.

The Public Prosecutor will then immediately inform the issuing judicial authority and agree a new surrender date with it. The wanted person shall then be surrendered at the latest within ten days of the new date agreed.

At the end of this period, if the wanted person is still in custody, he or she shall, unless the first paragraph of Article 695-39, released automatically.

Les dispositions de l’article 695-37 ne font pas obstacle à ce que la chambre de l’instruction, après avoir statué sur l’exécution du mandat d’arrêt européen, puisse surseoir temporairement à la remise pour des raisons humanitaires sérieuses, en particulier si la remise de la personne recherchée est susceptible d’avoir pour elle des conséquences graves en raison notamment de son âge ou de son état de santé.

Le procureur général en informe alors immédiatement l’autorité judiciaire d’émission et convient avec elle d’une nouvelle date de remise. La personne recherchée est alors remise au plus tard dans les dix jours suivant la nouvelle date convenue.

A l’expiration de ce délai, si la personne recherchée se trouve toujours en détention, elle est, sauf application du premier alinéa de l’article 695-39, remise d’office en liberté.
