Article 695-47 of the French Code of Criminal Procedure

The Minister of Justice authorises the transit through French territory of a person wanted under a European arrest warrant.

Where the wanted person is of French nationality or has been residing lawfully uninterruptedly for at least five years on French territory, authorisation may be made subject to the condition that, after being heard, he or she is returned to French territory to serve any custodial sentence that may be handed down against him or her by the judicial authority of the issuing Member State for the acts that are the subject of the arrest warrant.

Where the wanted person is of French nationality or has been residing lawfully and continuously for at least five years on national territory and the European arrest warrant has been issued for the execution of a custodial sentence or detention order, transit shall be refused.

Le ministre de la justice autorise le transit à travers le territoire français d’une personne recherchée en vertu d’un mandat d’arrêt européen.

Lorsque la personne recherchée est de nationalité française ou réside régulièrement de façon ininterrompue depuis au moins cinq ans sur le territoire national, l’autorisation peut être subordonnée à la condition qu’elle soit, après avoir été entendue, renvoyée sur le territoire national pour y subir la peine privative de liberté qui sera éventuellement prononcée à son encontre par l’autorité judiciaire de l’Etat membre d’émission pour les faits faisant l’objet du mandat d’arrêt.

Lorsque la personne recherchée est de nationalité française ou réside régulièrement de façon ininterrompue depuis au moins cinq ans sur le territoire national et que le mandat d’arrêt européen a été émis pour l’exécution d’une peine ou d’une mesure de sûreté privatives de liberté, le transit est refusé.
