Article 695-9-19 of the French Code of Criminal Procedure

Reasons shall be given for any refusal to execute an order freezing property or evidence. It shall be notified without delay to the judicial authority of the issuing State by any means that leaves a written record.

Where it is impossible to execute the freezing order because the property has disappeared, has been destroyed, has not been found at the location indicated in the certificate or it has not been possible to locate it, even after consultation with the judicial authority of the issuing State, the investigating judge shall inform the judicial authority of that State without delay by any means that leaves a written record.

Le refus d’exécuter une décision de gel de biens ou d’éléments de preuve est motivé. Il est notifié sans délai à l’autorité judiciaire de l’Etat d’émission par tout moyen laissant une trace écrite.

Lorsqu’il est impossible d’exécuter la décision de gel parce que le bien a disparu, a été détruit, n’a pas été retrouvé à l’endroit indiqué dans le certificat ou qu’il n’a pas été possible de le localiser, même après consultation de l’autorité judiciaire de l’Etat d’émission, le juge d’instruction en informe sans délai l’autorité judiciaire dudit Etat par tout moyen laissant une trace écrite.
