Article 696-101 of the French Code of Criminal Procedure

Recognition of the European protection order may be refused if the order is based:

1° On offences committed wholly, for the most part or for the most part on the territory of the Republic or in a place treated as such;

2° On offences for which the person suspected, prosecuted or convicted has already been finally judged by the courts of another State which is not a member of the European Union, provided that the sentence has been enforced, is being enforced or can no longer be enforced under the law of the State which handed down that sentence.

La reconnaissance de la décision de protection européenne peut être refusée si cette décision est fondée :

1° Sur des infractions commises en totalité, en majeure partie ou pour l’essentiel sur le territoire de la République ou en un lieu assimilé ;

2° Sur des infractions pour lesquelles la personne soupçonnée, poursuivie ou condamnée a déjà été jugée définitivement par les juridictions d’un autre Etat qui n’est pas membre de l’Union européenne, à condition que la peine ait été exécutée, soit en cours d’exécution ou ne puisse plus être mise à exécution selon la loi de l’Etat ayant prononcé cette condamnation.
