However, where it is necessary either to investigate a person or to place him or her under the status of an assisted witness, or to have recourse to investigative acts which can only be ordered in the course of an investigation, by reason of their duration or nature, the Deputy European Public Prosecutor shall conduct investigations in accordance with the provisions applicable to investigations, subject to the provisions of Section 3 of this Chapter.

When continuing investigations after the expiry of the investigation periods provided for in Article 75-3, the Deputy European Public Prosecutor is also required to proceed in accordance with the provisions applicable to the investigation.

Toutefois, lorsqu’il est nécessaire soit de mettre en examen une personne ou de la placer sous le statut de témoin assisté, soit de recourir à des actes d’investigation qui ne peuvent être ordonnés qu’au cours d’une instruction, en raison de leur durée ou de leur nature, le procureur européen délégué conduit les investigations conformément aux dispositions applicables à l’instruction, sous réserve des dispositions de la section 3 du présent chapitre.

Lorsqu’il poursuit les investigations après l’expiration des délais d’enquête prévus à l’article 75-3, le procureur européen délégué est également tenu de procéder conformément aux dispositions applicables à l’instruction.
